Contracting Entity and Scope
Legal entity and registration
These Terms govern the relationship between Live Traveller (OPC) Private Limited, a One Person Company incorporated under the Companies Act 2013, CIN U74999UP2020OPC131095, GSTIN 09AAECL2652A1ZV, registered office NO S29/418, SHEOPUR, VARANASI, Uttar Pradesh – 221003, India, and the person who makes a booking or is named on it. By making an enquiry, a booking or any payment you confirm you have read and accepted these Terms, are at least 18 years of age, and have authority to accept them for every traveller named on the booking.
Governing law and jurisdiction
These Terms are governed by the laws of the Republic of India. The courts having jurisdiction in Varanasi, Uttar Pradesh shall have jurisdiction over any dispute, unless mandatory consumer protection laws require otherwise. Nothing in this clause affects your right under the Consumer Protection Act 2019 to bring proceedings before the consumer forum where you reside or work.
The capacity in which we act
Live Traveller operates in two capacities, and which one applies to your booking is stated in your booking confirmation. As a Travel Agent we arrange third-party travel services on your behalf, and your contract for the service itself is with that supplier on the supplier’s terms. As a Tour Operator we design and sell packaged holidays under the Live Traveller brand and are responsible for delivering the arrangements described in your confirmation. We are not a marketplace. We do not act as the principal supplier of the underlying travel services unless your booking confirmation expressly states otherwise.
Booking and Payment
Booking confirmation
A booking exists only when we have issued a written booking confirmation and the deposit specified in it has been received in cleared funds. An itinerary, quotation or verbal indication does not create a booking. Please check your confirmation immediately; names must match the passport exactly. Corrections notified within 48 hours are made without an amendment charge where the supplier permits.
Deposit and balance
A booking deposit of 25% of the package cost, or 100% of the non-refundable components of your booking, whichever is higher, is payable to confirm. Where your itinerary includes components a supplier requires us to pay for in full and non-refundably at the time of booking, the deposit will exceed 25% and may be up to 100% of the total cost; the exact amount is stated in your quotation before you pay anything. The balance is payable by the date shown in your confirmation, set by supplier deadlines and generally 45–60 days before departure.
Payment methods and currency
We accept the payment methods shown in your quotation. All amounts are quoted and payable in Indian Rupees unless your quotation states otherwise.
Price changes
Prices are based on costs, exchange rates, taxes and supplier tariffs at the date of quotation. Once your booking is confirmed and the deposit received the package price is fixed, except for changes imposed by a government or regulator — including taxes, levies and visa fees — and supplier-imposed surcharges outside our control, which we pass on at cost with evidence.
Changes, Cancellation and Refunds
Relationship to the Refund Policy
Our Refund & Cancellation Policy forms part of these Terms and is incorporated by reference. Where these Terms and that Policy differ on cancellation charges, refund timelines or amendments, the Refund & Cancellation Policy prevails.
Amendments
Amendment requests must be made in writing. Where a supplier permits an amendment we pass on the supplier’s charge at cost, plus any fare or rate difference. Where an amendment is not permitted by the supplier it is treated as a cancellation and re-booking, and the cancellation charges apply. Name changes are governed by airline fare rules and are frequently not permitted.
Cancellation by Live Traveller
If we cancel your booking for any reason other than your default or force majeure, we will offer you a choice of an alternative date, a comparable alternative itinerary, or a full refund of all monies paid to us. Group departures may be subject to a minimum number of travellers, stated in your confirmation; if the minimum is not reached we will tell you as early as possible and offer the same choice.
Traveller Responsibilities
Passports, visas and entry rules
You are responsible for holding a valid passport, the correct visas, and any permits, vaccinations or documentation required by every country on your itinerary, including countries of transit. Many destinations require at least six months’ passport validity beyond your return date. We may provide guidance and, where offered, visa assistance, but the decision to grant a visa or entry rests solely with the relevant authority. No refund is due where a visa is refused, documentation is incomplete, or boarding or entry is denied. Visa fees are non-refundable once the application has been processed.
Insurance requirement
Comprehensive travel insurance is mandatory for every traveller and must be in place from the date of booking. It should cover cancellation, curtailment, medical expenses, repatriation, baggage and personal liability, and be adequate for the activities in your itinerary. We may ask for your policy number and insurer before departure. Premiums are non-refundable once the policy has been issued. Travelling without adequate insurance is at your own risk.
Health, fitness and special requirements
Tell us at the time of booking about any medical condition, disability, dietary requirement, reduced mobility or other circumstance that may affect participation. Some itineraries involve uneven ground, altitude, long transfers or limited access to medical facilities. We will make reasonable efforts to accommodate requirements notified to us but cannot guarantee every supplier can. Requirements disclosed after booking may incur additional cost or may not be accommodable.
Conduct
We may refuse to carry, or remove from any part of an itinerary, any traveller whose behaviour in our reasonable opinion causes or is likely to cause danger, distress, damage or serious disruption to others. Our responsibility for the booking then ends immediately, no refund is due, and we are not liable for resulting costs including repatriation. You are responsible for any damage or loss caused by you.
Liability and Risk
Limitation of liability
Where we act as Travel Agent our liability is limited to arranging your booking with reasonable skill and care. Where we act as Tour Operator we are responsible for delivering the arrangements described in your confirmation with reasonable skill and care, and our liability for any claim arising from a booking is limited to the total amount you have paid us for that booking, except where liability cannot be limited by law. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded, including under the Consumer Protection Act 2019.
Supplier acts and omissions
Where we act as Travel Agent we are not liable for the acts, omissions, delay, cancellation, overbooking, insolvency or default of a supplier, nor for the standard of a service delivered by them. Your remedy for the service itself lies against that supplier under its terms, and we will give you reasonable assistance in pursuing it.
Force majeure
We are not liable for failure to perform where caused by circumstances beyond our reasonable control, including war, civil unrest, terrorism, epidemic or pandemic, natural disaster, extreme weather, fire, industrial action, airspace or border closure, or governmental action. Where such an event affects your booking, refunds are governed by the Force Majeure clause of the Refund & Cancellation Policy.
Complaints and Disputes
Complaints procedure

Dispute resolution
We aim to resolve every dispute directly and quickly through our grievance procedure. Any dispute not resolved that way is subject to the laws of the Republic of India and to the jurisdiction of the courts at Varanasi, Uttar Pradesh, unless mandatory consumer protection laws require otherwise.
